Terms of Use

Please read these Terms of Use ("Terms") carefully before using SocialToolkit. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our website.

1. Acceptance of terms

By using SocialToolkit ("the website", "our service"), you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. These Terms apply to all visitors and users of the website, whether on a Free trial, Premium, or Pro plan.

2. Description of service

SocialToolkit provides AI-powered tools for content creators, including hashtag generation, caption writing, bio creation, video ideas, thread writing, blog intros, content repurposing, and other writing tools. We may update, modify, or discontinue any tool or feature at any time. Some tools and features are available during the Free trial; others require a paid Premium or Pro subscription or pay-as-you-go credits, as described on our account page.

3. Accounts

  • An account is required to use SocialToolkit, save content, use the calendar or templates, or subscribe to a paid plan.
  • You must provide accurate, current information, use a username you have the right to use, and not impersonate any person or entity.
  • You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized use.
  • You may not create more than one account, use false information, or create a new account if we have previously terminated one of yours.
  • You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms.

4. Trial, subscriptions & billing

  • New accounts start with a time-limited free trial with a declining daily generation allowance, as shown on your account page.
  • After the trial, continued use requires a paid Premium or Pro subscription (billed monthly or annually) or pay-as-you-go credits. Current pricing is shown on our account page.
  • Subscriptions are billed and processed by Paddle.com Market Limited, our authorized reseller and merchant of record. By subscribing, you authorize Paddle to charge your payment method on a recurring basis until you cancel. We are not responsible for errors, delays, or service issues caused by Paddle or your payment provider, and any dispute about a charge should first be raised with us so we can help resolve it.
  • Subscriptions renew automatically for the same billing period at the then-current price, unless cancelled before the renewal date.
  • You can switch between Premium and Pro, or between monthly and annual billing, at any time from your account page.
  • Pricing changes: We may change our subscription pricing at any time. If a price change affects your active subscription, we will notify you before it takes effect. If you don't agree with the price change, you may cancel your subscription.
  • Cancellation and refunds: All purchases are non-refundable, except where a refund is required by applicable law. You may cancel your subscription at any time from your account page. If you cancel, your subscription remains active until the end of the current billing period, and you will not be charged again afterward. No prorated refunds are given for the remainder of a billing period, and subscriptions cannot be terminated before the end of the period you've already paid for.
  • Pay-as-you-go credit packs are one-time, non-recurring purchases. Credits have no monetary value, are non-transferable, and do not expire unless stated otherwise on the account page.
  • We may suspend or downgrade your account if a payment fails and is not resolved within a reasonable time.

5. Free trial & usage limits

The free trial includes a limited, declining number of generations per day and access to a subset of tools. Paid plans are subject to a hidden fair-use daily limit to prevent abuse of "unlimited" access. We may change these limits at any time. Attempting to circumvent usage limits (e.g. via multiple accounts or automated requests) is prohibited under Section 6.

6. Acceptable use

You agree to use SocialToolkit only for lawful purposes. You must not use our service to:

  • Generate or share content that is illegal, hateful, discriminatory, threatening, abusive, or sexually explicit
  • Generate spam, deceptive content, or content that impersonates a real person or entity
  • Generate content intended to mislead others into believing it was not AI-assisted, where such disclosure is legally required
  • Attempt to interfere with, disrupt, or place unreasonable load on our website, servers, or rate limits
  • Use automated tools, bots, or multiple accounts to circumvent usage limits or scrape data from the site
  • Reverse engineer, decompile, or attempt to extract the source code of our tools
  • Resell or provide access to the service to others using your own account

We may remove content, and suspend or terminate accounts, that violate these Terms.

7. AI-generated content

Our tools use artificial intelligence (Google Gemini) to generate content suggestions ("Output"). As between you and SocialToolkit, we make no claim of ownership over Output you generate, and you are free to use it for your own purposes, subject to Section 6 above. You acknowledge that:

  • AI-generated content may not always be accurate, original, or suitable for your needs, and may resemble content generated for other users
  • You are solely responsible for reviewing and fact-checking any Output before publishing or relying on it
  • We do not guarantee that Output is free of third-party rights issues, and you are responsible for ensuring your use of it complies with applicable law
  • We do not guarantee that Output will achieve any particular result on social media

8. Intellectual property

The SocialToolkit website, including its design, logo, code, and content, is owned by SocialToolkit and protected by intellectual property laws. You may not copy, reproduce, distribute, or reverse engineer our website or tools without permission.

9. Feedback

If you send us suggestions, ideas, or feedback about SocialToolkit, you agree that we may use them freely, without any obligation to compensate you or credit you, and without any confidentiality obligation on our part.

10. Third-party services

Our website relies on third-party services to operate, described further in our Privacy Policy: Paddle (payment processing), Supabase (authentication and database), and Google Gemini (AI content generation). Use of these services is also subject to their own terms, and we are not responsible for their availability or practices.

11. Disclaimer of warranties

SocialToolkit is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The service will be uninterrupted, error-free, or available at all times
  • AI-generated content will be accurate, complete, original, or suitable for any purpose
  • The service will meet your specific requirements or expectations

12. Events beyond our control

We are not liable for any failure or delay in providing the service caused by events beyond our reasonable control, including internet or hosting outages, cyberattacks, government actions, or unavailability of a third-party service we rely on (such as Google Gemini, Supabase, or Paddle).

13. Limitation of liability

To the maximum extent permitted by law, SocialToolkit and its operators shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits or data, arising from your use of our website or Output generated by our tools. Our total liability to you for any claim relating to the service shall not exceed the greater of (a) USD $50, or (b) the amount you paid us in the 12 months before the claim arose.

14. Indemnification

You agree to indemnify and hold SocialToolkit harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your Output, or your violation of any law or third-party rights.

15. Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability, indemnification) will continue to apply.

16. Advertising

Our website may display advertisements through Google AdSense. We are not responsible for the content of advertisements displayed on our site. By using our website, you consent to the display of advertisements where enabled.

17. Changes to the service or these terms

We may modify, suspend, or discontinue any part of the service at any time. We may also update these Terms from time to time; changes take effect when posted on this page with an updated date. Continued use of the service after changes are posted means you accept the updated Terms.

18. General provisions

  • Entire agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and SocialToolkit about the service, replacing any prior agreements on the subject.
  • Severability: If any part of these Terms is found unenforceable, the rest will remain in full effect.
  • Waiver: If we don't enforce a right or provision, that's not a waiver of our ability to enforce it later.
  • Assignment: We may assign or transfer these Terms (for example, as part of a business sale); you may not, without our consent.
  • Electronic communications: You consent to receiving communications from us electronically (email or in-app notices), which satisfy any legal requirement for written communication.
  • Compliance: You confirm that you are not located in, or a resident of, any country or region subject to comprehensive trade sanctions, and that your use of the service complies with applicable export control and sanctions laws.

19. Governing law & disputes

These Terms are governed by the laws of Sri Lanka, without regard to its conflict of law principles. If a dispute arises, we ask that you first contact us (see Section 20) so we can attempt to resolve it informally and in good faith before pursuing any formal claim.
